Tiger Direct loses battle with Apple

Apple and judge maul TigerDirect

Two weeks after Tiger Direct announced that it was suing Apple (here) for using the Tiger name, the case has been thrown out of a Florida court.

The Florida judge ruled against Tiger Direct, who wanted complete ownership of the name, for its lawsuit over the 'Tiger' trademark saying that granting an injunction would do far more harm to Apple than Apple's use of the Tiger name can potentially do to Tiger Direct's business.

Philip Schiller, Apple's Vice President, said that Apple had not sought to exploit Tiger Direct's reputation when it used the Tiger name for OS X 10.4, pointing out to the court that Apple had used similar names for prior OS X releases, such as Jaguar and Panther.

Apple showed that over 200 registered companies in the US that use the Tiger within their brand, including 26 who are in the computer hardware and services business and that TigerDirect were no different.
